These Terms & Conditions govern your purchase, scheduling, participation in, and use of services provided by Ark Genesis, as well as your use of the Ark Genesis website.

By purchasing, scheduling, or participating in a service offered by Ark Genesis, you acknowledge that you have read, understood, and agreed to these Terms & Conditions and any policies incorporated into them.

Nature of Services

Services provided by Ark Genesis are spiritual and energetic in nature and are based on Ark Genesis’s individual methodology, observations, and practice.

Services may include energetic healing work, spiritual readings, assessments, interpretations, structural energetic work, mentorship, membership, and other spiritual or energetic services offered through Ark Genesis.

These services are intended for personal and spiritual exploration and are not medical, psychological, psychiatric, legal, financial, or other licensed professional services.

The terminology used by Ark Genesis to describe spiritual, energetic, or metaphysical concepts reflects the framework and methodology of the practice. Such terminology should not be understood as a medical, psychological, scientific, or other licensed professional diagnosis or representation.

Medical & Mental Health Disclaimer

Energy work and spiritual services are not substitutes for medical care, mental health treatment, diagnosis, medication, therapy, emergency services, or other care provided by appropriately qualified professionals.

No service offered by Ark Genesis is intended to diagnose, treat, cure, or prevent any physical or mental health condition.

Information or observations arising during a service should not be interpreted as medical or mental health advice or used as a substitute for evaluation or treatment by a qualified healthcare professional.

If you are experiencing physical or psychological symptoms, have concerns about your health, or believe you may require medical or mental health care, you are responsible for seeking assistance from an appropriately qualified professional.

No Guaranteed Outcomes

Every person’s system, circumstances, experiences, and response to energetic or spiritual work are different. Ark Genesis does not guarantee any particular outcome, result, experience, sensation, information, improvement, resolution, or timeline.

The amount and depth of information or energetic work available during a service may vary depending on the individual system, including its readiness, openness, current condition, energetic hygiene, previous personal work, and capacity to receive and integrate what is being addressed.

Purchasing a service does not guarantee that a particular issue, question, root cause, experience, person, event, spiritual concern, or desired information will be visible or accessible during the service.

It also does not guarantee that a particular issue will be resolved or that additional work will not be necessary.

The absence of a consciously perceived sensation, energetic shift, emotional response, or other noticeable experience does not establish that the agreed-upon service was not performed.

Client Responsibility & Integration

The work performed during a service is only one part of the process. The client remains responsible for how that work is integrated afterward.

A service may repair, clear, reorganize, restore, assess, or otherwise work with aspects of what Ark Genesis understands as a person’s energetic architecture, but the client remains responsible for their own choices, behaviors, awareness, boundaries, energetic hygiene, continued personal work, and wellbeing.

The effectiveness and longevity of energetic work may be influenced by the client’s circumstances and their willingness or ability to integrate what has been addressed.

If conditions, behaviors, relationships, environments, or patterns contributing to an issue remain unchanged, energetic work alone cannot guarantee a lasting outcome.

You remain solely responsible for your decisions and actions and for how you choose to understand, interpret, apply, or respond to information received through a service.

Remote & Offline Services

Unless otherwise specifically stated, Ark Genesis services are generally conducted remotely and offline.

No telephone call, Zoom meeting, video call, or live participation is required unless expressly included in the service purchased.

For offline services, there is nothing you are required to actively do while the service is taking place.

After completion, information associated with the service will be provided in the format described on the applicable service page, generally through a written report delivered by email.

Scheduling & Rescheduling

Services are generally scheduled directly with Ark Genesis through email.

If you need to reschedule a service before the work has begun, you may contact Ark Genesis to request another available date.

Rescheduling is subject to availability.

Ark Genesis may also reschedule a service when reasonably necessary. If this occurs, an alternative date will be arranged.

Cancellation and refund eligibility are governed by the Refund & Cancellation Policy available on the Ark Genesis website.

Scope of Services

Each service is limited to the scope described on the applicable service page and to what becomes available or appropriate within that service.

Not everything within a person’s energetic system will necessarily be visible, accessible, or appropriate to address at one time.

Spiritual and energetic work may unfold in layers, and additional information or areas of work may become available only after previous work has been addressed or integrated.

Purchase of one service does not create an ongoing obligation for Ark Genesis to provide additional readings, energetic work, investigation, personal guidance, interpretation of subsequent experiences, continued correspondence, or other support outside the scope of the service purchased.

Reasonable clarification regarding information contained within a completed session report may be provided when appropriate.

New questions, new developments, additional energetic concerns, requests for additional assessment, or matters requiring further investigation may require a separate service, membership, mentorship, or other appropriate arrangement.

Ark Genesis determines the reasonable scope of each service according to the service purchased and the methodology of the practice.

Services Involving Minors

Certain individual services may be provided to minors when Ark Genesis determines that the requested service is appropriate.

A parent or legal guardian must authorize and purchase a service provided to a minor.

Ark Genesis reserves the right to decline work involving a minor when the requested service is outside the scope of the practice or is otherwise considered inappropriate.

Services or spaces specifically designated as adults-only, including the Ark Genesis Insight Membership and associated private community, are available only to individuals 18 years of age or older.

Third Parties & Consent

Energetic work involving another person generally requires appropriate consent or authority to proceed.

You may not knowingly request unauthorized energetic work, assessment, or intervention involving another competent adult who has not consented to participate.

Where services involving a minor are permitted, authorization must be provided by the minor’s parent or legal guardian.

There may be limited circumstances in which information concerning another person becomes visible or relevant within the course of work properly authorized by the client. This does not create authorization for unrestricted assessment or intervention involving that person.

Ark Genesis reserves the right to limit or decline any request when appropriate consent or authority is not present.

Right to Decline, Limit, or Discontinue Services

Ark Genesis reserves the right to decline, limit, or discontinue a requested service when reasonably appropriate.

This may include circumstances in which the requested work falls outside the scope of the practice, appropriate consent or authority is unavailable, the requested work is not considered appropriate for the individual’s system, necessary information has not been provided, boundaries have been repeatedly violated, or continuing the service would otherwise be inappropriate.

Ark Genesis may also recommend a different service or type of support when a request falls outside the reasonable scope of the service purchased.

If Ark Genesis determines before beginning the work that it cannot provide a service that has already been paid for, the client will be offered an appropriate refund or alternative arrangement in accordance with the Refund & Cancellation Policy.

Payments, Cancellations & Refunds

Payment is required according to the price and payment terms communicated for the applicable service.

Payments, cancellations, rescheduling, and refunds are governed by the Ark Genesis Refund & Cancellation Policy in effect at the time of purchase.

By purchasing a service, you acknowledge that you have had an opportunity to review the applicable Refund & Cancellation Policy.

Nothing in these Terms or the Refund & Cancellation Policy is intended to limit any refund, cancellation, or other consumer right that cannot lawfully be waived.

Confidentiality

Information provided privately to Ark Genesis in connection with a service will be treated with respect and discretion.

Ark Genesis will not intentionally publicly disclose a client’s identity or personally identifying information obtained through a private service except with authorization, as reasonably necessary to provide the requested service, or where disclosure is required by law.

Anonymized portions of sessions, including excerpts, observations, themes, experiences, or examples of work performed, may be used for educational or promotional purposes on the Ark Genesis website, social media, Substack, or other platforms.

Any such material shared publicly will be presented without identifying the client.

Electronic communication, email, payment platforms, messaging applications, and other third-party technologies cannot be guaranteed to be completely private or secure.

Intellectual Property

Written session reports prepared specifically for a client may be retained, referenced, and shared by that client for personal purposes.

Ownership of a personal copy of a session report does not transfer ownership of Ark Genesis’s underlying intellectual property, methodologies, frameworks, terminology, educational material, or other proprietary content.

Unless otherwise stated, Ark Genesis retains all rights in its original methodologies, terminology, frameworks, educational materials, website content, written explanations, graphics, private membership materials, explorations, recordings, transcripts, and other original content.

Ark Genesis materials may not be copied, reproduced, republished, sold, commercially distributed, taught as another person’s methodology, modified and represented as original work, or otherwise commercially exploited without prior written permission.

Nothing in these Terms is intended to prevent a client from discussing their own experiences or personally using information provided to them.

Personal Interpretation & Decision-Making

Spiritual and energetic information may be understood and interpreted differently by different individuals.

Information provided by Ark Genesis is intended for spiritual and personal exploration and should not be used as the sole basis for medical, mental health, financial, legal, relationship, employment, safety, or other major life decisions.

Ark Genesis does not assume responsibility for decisions or actions you make based upon your interpretation or application of information received through a service.

You retain full responsibility and authority over your own choices and actions.

Third-Party Platforms, Services & Links

Ark Genesis may use or provide access to third-party websites, payment providers, email services, messaging platforms, community platforms, analytics providers, or other technologies in connection with its website and services.

These third-party services operate independently and may have their own terms, privacy policies, security practices, fees, availability, and technical requirements.

Ark Genesis does not control and is not responsible for the operation, availability, security, content, policies, or independent actions of third-party services.

Use of a third-party platform may also be subject to that provider’s own terms and policies.

Limitation of Liability

To the fullest extent permitted by applicable law, Ark Genesis will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages arising out of or relating to your use of the Ark Genesis website, purchase or use of a service, participation in spiritual or energetic work, reliance on information provided through a service, or use of third-party platforms associated with Ark Genesis.

You acknowledge that spiritual and energetic services are inherently individual in nature and that no particular result or outcome is guaranteed.

To the fullest extent permitted by applicable law, the total liability of Ark Genesis for any claim arising directly from a particular purchased service will not exceed the amount actually paid to Ark Genesis for that service.

The limitations contained in this section apply only to the extent permitted by applicable law.

Nothing in these Terms is intended to exclude, waive, or limit liability that cannot lawfully be excluded, waived, or limited.

Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, or reasonable expenses arising directly from your own unlawful conduct, intentional misuse of Ark Genesis services or materials, violation of another person’s rights, or material violation of these Terms.

This provision is not intended to require you to indemnify Ark Genesis for conduct for which Ark Genesis is legally responsible or for liability that cannot lawfully be transferred to you.

Changes to Services

Ark Genesis may modify, replace, discontinue, or update services, service structures, pricing, availability, policies, or features from time to time.

Changes will not retroactively alter the material terms of a service that has already been purchased unless the client agrees to the change or the modification is reasonably necessary and permitted by applicable law.

The description and terms presented at the time of purchase will generally govern that purchase.

Changes to These Terms

Ark Genesis may update these Terms & Conditions periodically to reflect changes in the practice, services, website, policies, third-party platforms, or applicable requirements.

The current version will be posted on the Ark Genesis website with an updated “Last Updated” date.

Unless otherwise required by law, revised Terms will apply prospectively from their effective date and will not retroactively change the material terms governing a service that was previously purchased.

Your continued purchase or use of Ark Genesis services after updated Terms become effective constitutes acceptance of the Terms applicable to those subsequent purchases or uses.

Severability

If any provision of these Terms is determined by a court or other authority of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where permitted.

If it cannot be made enforceable, it will be severed from these Terms.

The remaining provisions will continue in effect to the fullest extent permitted by law.

Waiver

If Ark Genesis does not immediately exercise or enforce a right or provision under these Terms, that does not constitute a waiver of that right or provision.

A waiver in one instance does not constitute a continuing waiver or a waiver of any other right or provision.

Entire Agreement

These Terms & Conditions, together with the Ark Genesis Refund & Cancellation Policy, Privacy Policy, applicable service description, and any additional terms expressly presented at the time of purchase, constitute the agreement between you and Ark Genesis concerning the service purchased.

If a service-specific term directly conflicts with a general provision of these Terms, the more specific term presented for that service will control with respect to that particular service to the extent of the conflict.

Governing Law

These Terms & Conditions and disputes arising from them will be governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Nothing in this provision is intended to deprive a consumer of rights or protections that cannot lawfully be waived under applicable law.

Acceptance of Terms

By purchasing, scheduling, or participating in an Ark Genesis service, you confirm that you are choosing to receive the service voluntarily and understand its spiritual and energetic nature.

You acknowledge that you have had an opportunity to review these Terms & Conditions, the applicable service description, and the Refund & Cancellation Policy before purchasing or participating in a service.

You understand that no particular result, experience, sensation, information, resolution, or outcome has been promised or guaranteed.

You further acknowledge that you remain responsible for your own decisions, actions, wellbeing, and integration and agree to be bound by these Terms to the extent permitted by applicable law.
